Terms of Service

1. Acceptance of Terms

By accessing or using ApeFX ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Ape AI ("we," "us," or "our"), the operator of ApeFX.

2. Description of Service

ApeFX is an AI-powered content generation platform that allows users to create images, videos, and other visual media using third-party AI models. The Service is provided on a credit-based system. Generated content quality, availability, and output characteristics are subject to the capabilities of the underlying AI models and may vary.

3. User Accounts & Registration

You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at [email protected] if you suspect any unauthorised use.

You must be at least 13 years old to use the Service. If you are under 18, you must have the consent of a parent or legal guardian.

4. Acceptable Use Policy

You agree not to use the Service to generate, upload, share, or request content that:

  • ✕Constitutes or depicts child sexual abuse material (CSAM), zero tolerance; violations will be reported to relevant authorities immediately.
  • ✕Creates deepfakes or realistic likenesses of real, identifiable people without their explicit written consent.
  • ✕Is illegal under applicable law, including content that promotes violence, hatred, or discrimination.
  • ✕Infringes third-party intellectual property rights, including copyrights or trademarks.
  • ✕Is used to harass, threaten, or harm any individual or group.
  • ✕Attempts to reverse-engineer, scrape, or abuse the Service infrastructure.

We reserve the right to suspend or terminate accounts that violate this policy at our sole discretion and without prior notice.

5. Credits & Payments

The Service operates on a credit-based system. 1 credit = $0.01 USD. Credits are consumed when you submit generation requests. The credit cost is displayed before each generation.

Subscription plans include a 7-day money-back guarantee. If you are not satisfied within 7 days of your first payment on a paid plan, contact us at [email protected] for a full refund. This guarantee applies once per account.

Monthly subscription credits roll over on all paid plans, so your balance carries forward. Top-up credits purchased separately are non-refundable once purchased and do not expire.

Credits consumed in failed or errored generations are automatically refunded to your account balance. Payments are processed in USD via third-party payment providers and are subject to their terms.

You may cancel your subscription at any time by emailing [email protected]. Your plan remains active until the end of the current billing period.

We reserve the right to modify credit pricing with 14 days' notice to existing subscribers.

6. Intellectual Property

Your outputs: Subject to these Terms and the terms of underlying AI model providers, you own the content you generate using the Service on paid plans. Free plan outputs may carry a watermark and are subject to additional restrictions.

Our platform: ApeFX, its branding, software, interfaces, and all underlying technology are owned by Ape AI and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable licence to access and use the Service.

By using the Service, you grant us a non-exclusive, royalty-free licence to process your inputs and generate outputs solely for the purpose of providing the Service.

7. Third-Party AI Services

The Service uses third-party AI inference providers including FAL AI and Kie.ai. Generated outputs are subject to these providers' terms of service and acceptable use policies in addition to ours.

We are not responsible for the content, accuracy, or availability of third-party AI model outputs. Model availability may change without notice.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZERAMENTAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa. If you are a consumer in another jurisdiction, you may also have rights under the laws of that jurisdiction.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and, where appropriate, by sending an email to your registered address. Your continued use of the Service after the effective date of changes constitutes your acceptance of the updated Terms.
